That Council conditionally approve Development Permit #12-D-190 to construct a residence with an attached garage on Plan 9223029, Block 0, Lot 3, Entwistle, W5-07-53-20-SW.

Administration Recommendation(s)
To conditionally approve Development Permit #12-D-190 for the construction of a single detached dwelling and attached garage on Plan 9223029, Block 0, Lot 3, Entwistle, W5-07-53-20-SW with the following conditions:
1. The exterior of the single detached dwelling shall be finished in the manner shown on the submitted drawings.
2. The proposed development shall be sited, oriented and conform to all building setbacks as shown on the submitted site plan and shall not be moved or enlarged except where authorized or directed through this permit approval.
3. Prior to construction or commencement of any development, owner/developer or contractor is responsible to obtain building, electric, plumbing and gas permits required. Permits must be obtained from Parkland County.
4. All development shall be graded and landscaped in a manner to prevent any surface run-off onto adjacent properties, as shown on the submitted documentation.
5. The developer shall remove all garbage and waste at his/her own expense and keep the site in a neat and orderly manner.
6. Any changes or additions to this permit shall require a new development permit application.
7. Failure to comply with the conditions of this permit may result in the permit being cancelled, suspended or modified.
Purpose
The proposed development is within the Direct Control District and therefore must be approved by Council.
Summary
The applicant is requesting approval to construct a single detached dwelling and attached garage within a Direct Control District.
It appears that the residential nature is established on the surrounding properties as shown on the aerial photograph (attachment A). To allow this type of development should not have a negative impact on the adjacent properties.
The setbacks shown on the site plan submitted (attachment B), as part of the Development Permit Application, are in keeping with setbacks shown in other districts as regulated by Parkland County's Land Use Bylaw 20-2009.

Municipal Development Plan 37-2007
The Municipal Development Plan supports direction residential growth within hamlets that have a full range of utilities and services.
The subject property is identified on the 2007 MDP Map 2, Land Concept Map, as being within the hamlet. There are no special requirements outlined in the MDP regarding the notification or referral process.
Land Use Bylaw 20-2009
The subject lands are located within a Direct Control District as shown on Schedule 1, Entwistle Urban Village District Map.
The current lands are vacant.
Section 5.11.1(e) Direct Control states that this district shall be regulated as per Section 9 Direct Control District (DC).
Section 9 - Direct Control (DC)
The general purpose is to enable and permit Council to regulate and control the use, development in an area designated as a Direct control on the Land Use District in Part 2 of the LUB. There are no requirements for any special notification or referral process.
