Administration supports the adoption of  Bylaw No. 32-2012, as revised.  
 
Purpose
Council has directed Administration to update the Acheson Industrial ASP.
Summary
Council heard public comment on the Draft Acheson Area Structure Plan (proposed Bylaw 32-2012) at a public hearing held on November 6, 2012.  Council then directed Administration to table proposed Bylaw 32-2012 for second reading on November 20, 2012.   Based on feedback provided by the public, Council, and Administration, a number of minor revisions to the Draft ASP have been recommended.  Revisions include:
1. A text amendment to the "Development timing" heading found in Section 5.11 - Special Study Areas;
2. Text amendments to policies 7.1.2.6, and 7.1.2.7 requiring compliance with Energy Conservation Resource Board setback requirments, and federal and provincial health and safety requirements for subdivision or development near wells;
3. Two new policies in Section 6.9 - Oil and Gas Development, requiring compliance with Energy Conservation Resource Board setback requirements for subdivision or development near existing (operational) wells, and abandoned wells;
4. Text amendment to policies 6.2.2.13, and 6.6.2.14 to remove the last sentence of both policies related to full municipal servicing of Osborne Acres upon full build out of Acheson (the remaining policies remain); and,
5.  Removal of references to Highway 16A as having "freeway status".
Other proposed revisions to the Draft ASP include minor mapping revisions to Figure 5 - Future Land Use Concept Map, and Figure 13 - Development Staging, minor text revisions to correct spelling and grammar mistakes, and minor wording changes to clarify existing text and policies.  Proposed revisions can be found in Attachment 2 - Acheson Area Structure Plan (2012) (revised).  
 
Administration has also prepared a summary of  issues raised at the Pubilc Hearing on November 6, 2012.   The summary can be found in Attachment 3.  Options (where applicable), and Administration's recommendations for each issue have also been provided.   
 
Strategic Plan/Policy/Legal/Staff Implications
If proposed Bylaw 32-2012, as revised, receives second reading, Administration requests to be directed to forward the proposed Bylaw to the Capital Region Board for approval.  Proposed Bylaw 32-2012 would be forwarded to the Capital Region Board in conjunction with proposed Bylaw 33-2012 (amendments to the Municipal Development Plan).

Alternate Motions:
Alternative Motions include:
a) Table second reading of the proposed Acheson Industrial Area Structure Plan Bylaw No. 32-2012, as revised, and request further information.
b) Refuse second reading of the proposed Acheson Industrial Area Structure Plan Bylaw No. 32-2012, as revised.
If Council chooses to table second reading of Bylaw No. 32-2012, as revised, Administration requests Council to provide direction as to what type of information is requested.     
 
If Council chooses to refuse second reading of the Acheson Industrial ASP Bylaw No. 32-2012 with the proposed revisions, Administration recommends that the proposed Bylaw not be submitted to the Capital Region Board.  In addition, Administration recommends that the existing Acheson Industrial ASP Bylaw No. 20-97 and all amendments thereto, not be rescinded to ensure that an area structure plan (Bylaw No. 20-97) would still exist for the Acheson area.  Administration would also request that Bylaw No. 33-2012 (amendments to the MDP) not proceed.
