Administration Recommendation(s)
Administration supports the adoption of Bylaw No. 2014-28. Bylaw No. 2014-28 proposes minor text, mapping and policy amendments to Municipal Development Plan Bylaw No. 37-2007. Amendments to the Municipal Development Plan are being proposed to ensure consistency with the updated Acheson Industrial Area Structure Plan (proposed Bylaw No. 2014-29).
Purpose
Bylaw No. 2014-28 is being proposed to ensure consistency between the Municipal Development Plan Bylaw No. 37-2007 and the updated Acheson Industrial Area Structure Plan (proposed Bylaw No. 2014-29).
Summary
Under Section 638 of the Municipal Government Act, statutory plans must be consistent with each other. Amendments proposed in Bylaw No. 2014-28 are relatively minor, and, if approved by Council will ensure that both the Municipal Development Plan (MDP) and the updated Acheson Industrial Area Structure Plan (proposed Bylaw No. 2014-29) are consistent in wording, policy, and mapping.
Administration is proposing the following changes to the MDP:
1. Minor text amendment: Section 1 - Introduction
This proposed amendment will replace the date of adoption, and the name of the Acheson Industrial Area Structure Plan (MDP Section 1 - Introduction, item no. 13).
2. New Policy: Section 5- Industrial and Commercial Development
A new policy is being recommended under Section 5 - Industrial and Commercial Development in the MDP. The new policy would state that the County will continue to encourage the extension of piped water and sewer services into the Acheson Business Park, and that the County would recover the costs of extending services through an offsite levy bylaw or other cost recovery method.
3. New Policy: Section 10- Transportation and Utilities
A new policy is being recommended under Section 10 - Transportation and Utilities in the MDP. The new policy would state the requirement for all future industrial and commercial developments in the Acheson area to be fully serviced by municipal (water and sanitary) servicing, and that the County would recover the costs of extending these systems through an offsite levy bylaw.
4. New Policy: Section 11 - Fringe Area Development
A new policy is being recommended under Section 11 - Fringe Area Development that specifies that Parkland County will consult with the City of Edmonton and landowners on future land use designations on lands designated Agricultural Area B in the Acheson Industrial Area Structure Plan Bylaw 2014-29.
5. Map Amendment Map 2 - Land Use Concept Map
Map 2 - Land Use Concept Map in Municipal Development Plan Bylaw 37-2007 will require several map amendments to redesignate specific policy areas to align with the Acheson Industrial Area Structure Plan Bylaw 2014-29. These include:
(a) The "Proposed Outer Ring Road" road alignment identified in Map 2 - Land Use Concept Map, will be removed based on the current direction provided by Alberta Transportation.
(b) A 200m by 800m strip of land on the west side of NW-29-52-26-W4thM will be redesignated from Fringe to Agriculture.
(c) All that potion of SE&SW 6-53-26-W4thM that lies south of the railroad and north of Provincial Highway 16A and NE&NW 31-52-26-W4thM excepting thereout Lot 4 Plan 167MC will be redesignated from Agriculture to Industrial/Commercial.
(d) Portions of SEC 32-52-26-W4thM, SW 33-52-26-W4thM, NW&NE 28-52-26-W4thM and NW&NE 29-52-26-W4thM will be redesignated from Fringe to Industrial/Commercial
Specific lands identified for amendment in Map 2 - Land Use Concept Map are identified in attached Schedule A of proposed Bylaw No. 2014-28.
7. Map Amendment: Map 3 - Parkland County Area Structure Plans
Map 3 - Parkland County Area Structure Plans in Municipal Development Plan Bylaw 37-2007, will require a map amendment to the Acheson Industrial ASP plan boundaries. The boundary for the Acheson Industrial ASP shall be extended west to include Section 7-53-26-W4M, Section 6-53-26-W4M, the E 1/2 of Section 12-53-27-W4M, E 1/2 of Section 1-53-27 W4M, and the N 1/2 of Section 31-52-26 W4M. In addition, a 200m wide area, extending in a north to south direction, along the western edge of NW 29-52-26-W4M will be removed from the Acheson Industrial ASP plan boundary. Map 3 will also be amended to reflect the City of Spruce Grove's current corporate boundary.
The purpose of this map amendment is to ensure that the current boundaries of the Acheson Industrial ASP are reflected in the Municipal Development Plan. Map amendments are identified in attached Schedule B of proposed Bylaw No. 2014-28.
Administration is including a combined list of speakers wishing to speak on both Bylaw 2014-28 (amendments to the MDP Bylaw 37-2007), and for Bylaw 2014-29 (approval of the Acheson ASP). The combined list of speakers is included in Attachment 2 - Combined List of Speakers. Administration has also received written submissions on Bylaw 2014-28. These are included in Attachment 3 - Written Submissions. An Administrative Report (attachment 7) provides greater detail on the proposed changes to the Acheson ASP and details on why proposed amendments (as noted above) are required for the Municipal Development Plan. This administrative report is also included in the Council Report for proposed Bylaw 2014-029.
Council approved first reading of Bylaw 2014-28 on November 25, 2014.
Strategic Plan/Policy/Legal/Staff Implications
By approving proposed Bylaw No. 2014-28, Council will ensure that both the Municipal Development Plan Bylaw 37-2007, and the updated Acheson Industrial ASP (proposed Bylaw No. 2014-29) are consistent in wording, policy, and mapping. This approval will also ensure the County remains compliant with Section 638 of the Municipal Government Act.

b) Refuse second reading of Bylaw No. 2014-28.
