Administration supports the proposed Bylaw as presented provided no appeal has been filed to the CRB.
Purpose
The Applicant is requesting a Municipal Development Plan amendment to redistrict the subject lands to accommodate a natural gas fired power plant on W5-04-52-10-NW & SW.
Summary
The Applicant has applied for an amendment to Map 2 of Municipal Development Plan Bylaw No. 37-2007 to redesignate approximately 120 ha (297 ac) of land within W5-04-52-10-NW & SW from Agriculture to Industrial/Commercial to accommodate a new natural gas fired power plant on W5-04-52-10-NW & SW. The applicant has undergone substantive public engagement as part of this project and provided several background reports that support the proposed land use. The application is consistent with the Capital Region Growth Plan and general policies of the Municipal Development Plan and Highvale End Land Use Plan. Administration is of the opinion that this is an appropriate location for this type of land use while taking advantage of existing infrastructure already developed while having the least amount of impact on the community/region as far as adjacent land uses.
Parkland County referred proposed Bylaw 2014-24 to the Capital Region Board following the public hearing on September 23, 2014. The CRB recommended approval of the REF application on October 30, 2014. In accordance with the amended REF Administration Procedures the CRB Administration recommendation may be appealed to the Board by any CRB member municipality within 28 calendar days of the posting of the recommendation on the CRB website.  Therefore any Notice of Appeal to the Board must be received by CRB Administration on or before 4:30 p.m., November 27, 2014. As of the date of this report no appeal has been received.
 
Strategic Plan
Bylaw No. 2014-24 is consistent with Goal 1 under the Economy Section of Parkland County Council's Strategic Plan: "Parkland County has a prosperous and sustainable economy". Therefore, Administration supports the proposed amendment to Land Use Bylaw 20-2009 as presented.
Financial Impact:
Revenue:  $3,000.00 + GST Land Use Bylaw Amendment Application Fee paid by Applicant
Note: As the Bylaw has proceeded beyond first reading, the Applicant is no longer entitled to a refund of the application fee.
 
Alternatives:
    1) Council could table Bylaw No. 2014-24 and request additional information from Administration, the Applicants; or
    2) Council could defeat Bylaw No. 2014-24 at third reading; or
    3) Council could amend Bylaw No. 2014-24 prior to third reading.
