Purpose
The Applicant is requesting a Land Use Bylaw amendment to redistrict the subject lands in order to pursue additional subdivision on the quarter section of land.
Further details are provided by the Applicant in the Attachment "Applicant's Letter".
 
Summary
The subject 100 acres are currently districted within the ANC - Agricultural / Nature Conservation District under the Land Use Bylaw. The ANC District only allows a single residential parcel of a maximum parcel size of 4.05 ha (10.0 ac) from an original quarter section of land. The subject quarter section already has one subdivision of 24.28 ha (60 ac) which is also owned by the Applicants but is districted AGG - Agricultural General District. The Applicants wish to reduce the size of the existing subdivided parcel from 60 acres to 10 acres as well as to subdivide two additional residential parcels from the quarter section consistent with the AGG - Agricultural General District. The Applicants note that the recently updated and amended Environmental Conservation Plan as accepted by Council no longer identifies any portion of these lands as being within an Environmentally Significant Area. As the current Environmental Conservation Plan no longer identifies the subject lands as being within the Pembina River Valley Environmentally Significant Area, more intensive agricultural activities and related uses should be permitted as can be considered under the AGG - Agricultural General District compared to the current and more restrictive ANC - Agricultural / Nature Conservation District.
 
As of the date of this submission, no written comments or requests to speak before Council at the Public Hearing have been received.

Strategic Plan 2014-2018 / Environmental Conservation Master Plan
Bylaw No. 2015-02 is consistent with Commitment 3 under the Environment Section of the Strategic Plan: "Ensure development respects the environment".
Bylaw No. 2015-02 is consistent with Commitment 2 under the Agriculture Section of the Strategic Plan: "Support initiatives that provide a local food supply to the region".
Bylaw No. 2015-02 is consistent with the Environmental Conservation Master Plan (2014) which identifies the subject lands as being located ' outside' within the Pembina River Valley Environmental Significant Area.
 
Financial Impact:
Revenue: $2,500.00 +GST Land Use Bylaw Amendment Application Fee paid by applicant
Note: The applicant is no longer entitled to a refund as the application has proceeded to public hearing and advertising has been completed.
 
Alternatives:
1.  Council could table the Public Hearing regarding Bylaw No. 2015-02 and request additional information from Administration, the Applicants; or
2.  Upon closing the Public Hearing, Council could defeat Bylaw No. 2015-02 at second reading; or
3.  Council could close the Public Hearing and give second reading, but defer third reading to a later date.
