Administration Recommendation(s)
Administration is of the opinion that the Public Hearing regarding Bylaw No. 2013-20 should be recessed until the unresolved matters as detailed in the attached Administrative Report have been satisfactorily addressed by the primary Applicant (Parkland Estates Development Corp.).  Administration previously advised the Applicant prior to and at the August 27, 2013 Council Meeting (1st Reading) that it would be unable to support the application at Public Hearing unless these matters were addressed. To date, Administration has not received satisfactory responses on several storm water management and other issues. Administration has reserved the following potential dates to reconvene the Public Hearing subject to Council approval:
      - November 26, 2013 @ 10:30 a.m.
         - December 10, 2013 @ 9:30 a.m. (Budget Day)
 
Purpose
The two Applicants are requesting an amendment to the Land Use Bylaw to facilitate a potential lot line adjustment between the two titled areas, and to facilitate the development of additional serviced industrial/commercial development on the identified lands within NW 11-53-26-W4M and within Zone 2 of Acheson Industrial Area.
 
Summary
Amendments have been requested to the Land Use Bylaw. The proposed redistricting and development of lands within NW 11-53-26-W4M for serviced industrial / commercial use within the BI - Business Industrial District under the Land Use Bylaw is consistent with the land use policies under the Capital Region Growth Plan, the County's Municipal Development Plan Bylaw No. 37-2007 and Acheson Industrial Area Structure Plan Bylaw No. 20-97. Please reference the attached Administrative Report.
 
This Bylaw amendment was referred  to adjacent landowners, City of Edmonton,  Alberta Transportation, Acheson Business Association and the Wagner Natural Area Society. It was advertised in the September 13th and 20th, 2013 editions of the Spruce Grove Examiner and Stony Plain Reporter.  As of the date of this Report's preparation no responses were received by Administration.
 
Strategic Plan/Policy/Legal/Staff Implications (As Required)
Bylaw 2013-20 is consistent with Municipal Development Plan Bylaw No. 37-2007 and Acheson Industrial Area Structure Plan Bylaw No. 20-97. Bylaw No. 2013-20 is consistent with Goal 1 under the Economic Development Section of Parkland County Council's Strategic Plan: "Parkland County will mitigate its revenue risk through diversification of its revenue stream".

Alternatives
1) Recess the Public Hearing pending the Applicants providing Administration with satisfactory responses to the unresolved matters
2) Upon closing the Public Hearing, Council could defeat Bylaw No. 2013-20 at second reading, .
3) Council could close the Public Hearing and give second reading, but defer third reading to a later date.
4) Council could close the Public Hearing and give second and third reading.
