Purpose

To designate the owner of a manufactured home community as the assessed person for a designated manufactured home in a manufactured home community.

 

Summary

Section 304(1)(j)(ii) of the Municipal Government Act (MGA) of Alberta establishes the assessed person of a designated manufactured home on a site in a manufactured home community, and any other improvements located on the site that are owned or occupied by the person occupying the designated manufactured home, to be the owner of the manufactured home community.

 

Designating the manufactured home community as the assessed person streamlines the tax process by consolidating approximately 800 tax rolls for the manufactured home community into one tax roll.

 

Council gave first reading to Bylaw 2016-03 on January 12, 2016, pursuant to section 304(1)(j)(ii) of the MGA.  A bylaw passed under section 304(1)(j)(ii) must be advertised and has no effect until the beginning of the year commencing at least 12 months after the bylaw is passed.  The bylaw was published in the January 15 and 22, 2016 editions of the newspaper as required by legislation. 

 

Electors had until March 22, 2016 to submit a petition to the Chief Administrative Officer (CAO) to determine whether the bylaw should be passed by Council.  No petition was received by the CAO, so Council may give second and third readings to the bylaw.

Section 606 of the MGA requires notice of the bylaw to be published at least once a week for 2 consecutive weeks in at least one newspaper or other publication circulating in the area to which the proposed bylaw relates.

 

Section 231(4) of the MGA allows a petition for a vote of the electors on a proposed bylaw that is advertised within 60 days after the last date on which the proposed bylaw is advertised.  The last day to file a petition with the CAO was March 22, 2016.
