Administration Recommendation
Administration supports the adoption of Bylaw 2014-29. The Acheson Industrial Area Structure Plan (ASP) will provide certainty as to how and when the Acheson area will develop in the future. The Bylaw proposes an orderly and efficient development pattern that highlights the importance of Acheson as an employment centre in the Capital Region, while balancing the needs of adjacent municipalities and stakeholders. Adoption of the Acheson Industrial ASP Bylaw No. 2014-29 will replace the existing Acheson Industrial Area Structure Plan Bylaw No. 20-97 and amendments thereto (includes Bylaw No. 45-2000, Bylaw No. 47-01, Bylaw No. 11-2009, and Bylaw No. 37-2011).
Purpose
Council has directed Administration to update the Acheson Industrial ASP.
Summary
On December 16, 2014, Council closed the Public Hearing for Bylaw 2014-29. On that same date, Council also required several changes to the Draft Acheson Industrial Area Structure Plan (ASP) and provided Second Reading to Bylaw 2014-29. Administration undertook all required changes to the Draft ASP and forwarded Bylaw 2014-29 (along with Bylaw 2014-28) to the Capital Region Board (CRB) for approval.
On February 9, 2015, CRB Administration informed Parkland County that the Regional Evaluation Framework (REF) application # 2015-001 (Parkland County bylaws 2014-28 and 2014-29) were being recommended for approval. Third party evaluators retained by the CRB to review REF # 2015-001 found the Draft Acheson Industrial ASP, and proposed amendments to the Parkland County Municipal Development Plan consistent with the intent and objectives of the Capital Region Growth Plan. The CRB Administration Recommendation is attached as attachment 5. The CRB third party evaluation is attached as attachment 6.
On March 9, 2015, the Notice of Appeal period for REF # 2015-001 was closed. The Capital Region Board has confirmed that no appeals by CRB member municipalites have been submitted. As such, CRB approval of REF # 2015-001 has been confirmed. Parkland County, under Ministerial Order M.O. 270/10, can now provide third reading and final approval to Bylaw 2014-28 and Bylaw 2014-29.
Strategic Plan/Policy/Legal/Staff Implications
Municipal Development Plan Bylaw No. 37-2007
Third reading of Bylaw No. 2014-28 is being brought forward at the same meeting for third reading of Bylaw No. 2014-29. Bylaw No. 2014-28 proposes changes to the Municipal Development Plan. Proposed amendments include a minor text amendment to Section 1 - Introduction, the addition of a policy in Section 5 - Industrial and Commercial Development, the addition of a policy in Section 10 - Transportation and Utilities, a new policy under Section 11 - Fringe Area Development, and map amendments to Map 2 - Future Land Use Concept Map, and Map 3- Parkland County Area Structure Plans.
All amendments requried by Council at second reading have also been incorporated into Bylaw 2014-28.
Changes proposed in the Municipal Development Plan Bylaw are being proposed to ensure compliance with Part 17, Section 638 of the Municipal Government Act which requires all statutory plans to be consistent with each other.
Rescinding of Bylaw No. 20-97 as amended
Adoption of the Acheson Industrial ASP Bylaw No. 2014-29 will require Bylaw No. 20-97 (the current Acheson Industrial ASP) and all amendments thereto to be rescinded. Council will be asked to rescind these as part of the Acheson Industrial ASP Bylaw No. 2014-29 approval.

Alternative Motions include:
a) Table third reading of the proposed Acheson Industrial Area Structure Plan Bylaw No. 2014-29 and request further information.
b) Refuse third reading of the proposed Acheson Industrial Area Structure Plan Bylaw No. 2014-29.
If Council chooses to table third reading of Bylaw No. 2014-29, Administration requests Council to provide direction as to what type of information is requested.
