Purpose
Sale of Properties Policy AD 003, last reviewed in 2001, requires rescinding by Council to allow administration to approve Administrative Directive A-AD03.
Summary
Administration continues its overall review of Parkland County policies to ensure that our policies are current and up-to-date, and meet the standards of Policy Development Policy C-AD01 which provides for both Council Policies and Administrative Directives. As part of its ongoing review, administration is separating administrative and operational matters from Council Policies. Sale of Properties Policy AD 003 is viewed as an administrative policy. It's been reviewed by Legislative and Administrative Services, and discussed and supported at recent Executive Committee and Management meetings.
New Directive A-AD03 will continue to provide administrative processes for selling tax recovery properties pursuant to the Municipal Government Act, and other properties that Council wishes to dispose. Directive A-AD03 permits all offers to purchase properties, at or greater than fair market value, to be considered and approved by Legislative and Administrative Services. Council may direct administration to proceed with the marketing of properties, however, it is not necessary for Council to approve such property sales. Only in circumstances where an offer to purchase a property for less than market value is being considered, would Council be required to make such a decision.
Strategic Plan/Policy/Legal/Staff Implications
Council's 2014-2018 Strategic Plan commits to ensuring Council policies are effective, responsible, and aligned with its goals and vision (referred to under Governance). Policy Development Policy C-AD01 provides for Administrative Directives which are approved by the Chief Administrative Officer, and direct staff regarding operational matters and internal administration.
