Proposed Motion
That Council direct Administration to communicate with Transport Canada advising that Parkland County will withhold local authority consent for the certification of the Parkland Aerodrome Development and Airport until such time as Parkland County consults with Canadian Environmental Assessment Agency (CEAA) and secures participation status if an Environmental Assessment for the lands on or adjacent to the aerodrome are required.

Purpose
The purpose of this report is to follow-up on the recommendations of legal counsel in regards to taking actions on the Certification of the Parkland Airport Development Corporation (PADC) Aerodrome, and the tabling motion from the December 16, 2014 Council meeting .
 
Summary
In early 2013, The Parkland Airport Development Corporation (PADC) commenced development of an Aerodrome in the SE corner of Parkland County.  Development of the initial Aerodrome commenced without the involvement or approval of Parkland County or its residents. Development of the Aerodrome was opposed by Parkland County on the bases of development approvals which may or should be required by the local authority, and continues to be opposed by many adjacent property owners (to the Aerodrome).  Through the initial 18 months it has become clear to Council and administration through the challenges which have been pursued that the ultimate approval of an Aerodrome (or Certified Airport) at this location lies with Transport Canada.  Hence, Parkland County is limited in what controls are available to the municipality.
 
The next stage of development of the PADC Project (as directed by the Federal Transportation Minister) is to Certify the Aerodrome as an Airport.  Based on a legal review of the matter and advice secured by Parkland County the following two motions were passed by County Council on December 16, 2014 - and the remaining action as outlined in the Proposed Motion of this Report was tabled to the January 13, 2015 regular Council meeting.
 
At its December 16, 2014 meeting of Council the following motion was passed, "that Administration be directed to communicate with Transport Canada advising that Parkland County withhold local authority consent for the certification of the Parkland Aerodrome Development and Airport until such a time as Parkland County commences and negotiates a Memorandum of Agreement (between Parkland County and the Parkland Aerodrome Development Corporation) regarding those activities falling under the Aeronautic Act and those under municipal jurisdiction."
 
Additionally, and also at its December 16, 2014 meeting of Council, the following motion was passed, "that Administration be directed to communicate with Transport Canada advising that Parkland County withhold local authority consent for the certification of the Parkland Aerodrome Development and Airport until such a time as Parkland County enter into an with Transport Canada to retain zoning and land use regulation authority over the lands adjacent to the Aerodrome (Airport Vicinity Protection Area)."
 
Lastly, at its December 16, 2014 meeting of Council did not pass the following motion.  "That Administration be directed to communicate with Transport Canada advising that Parkland County will withhold local authority consent for the certification of the Parkland Aerodrome Development and Airport until such time as Parkland County retain expert analysis to determine the environmental transportation, and adjacent land use impacts of the airport operations."
