Submission of Parkland County letter to the Capital Region Board regarding proposed amendments to the City of Spruce Grove's Shiloh Area Structure Plan
Proposed Motions:
a) That Administration submit a letter to the Capital Region Board outlining the County's support of the proposed amendments to the City of Spruce Grove Shiloh Area Structure Plan, and supporting MDP amendments. And, further that this support be contingent upon future consultation by the City of Spruce Grove with Parkland County, and that a Memorandum of Understanding be entered into by Parkland County, the Town of Stony Plain, and the City of Spruce Grove.

Purpose
Administration is requesting a Council motion to submit a letter to the Capital Region Board in regards to the proposed amendments to the City of Spruce Grove Shiloh Area Structure Plan, and the City of Spruce Grove Municipal Development Plan. Administration feels that a number of outstanding issues currently exist with the proposed amendments, and that issues need to be addressed prior to final approval of these amendments being granted by the Capital Region Board, and adopted by the City of Spruce Grove.
Summary
Administration believes that proposed amendments to the Shiloh Area Structure Plan in particular may have potential implications for Parkland County in the future (see Attachment 1 - Administrative Report).
Proposed amendments to the City of Spruce Grove Area Structure Plan identify the potential future extension of a road network into NE 29-52-27-W4M, and the extension of the storm water management system for the Shiloh area into the northwest corner of this quarter-section. Quarter section NE 29-52-27-W4M falls inside the boundary of Parkland County. While NE 29-52-27-W4M does not fall within the Shiloh ASP boundary itself, Administration feels that issues related to the future extension of the road network and storm water management system into Parkland County have not been addressed by Spruce Grove or the Shiloh area developers and consultants. Attachment 2 outlines the Plan Area for the Shiloh Area Structure Plan.
Administration attended a joint meeting with the The Town of Stony Plan, City of Spruce Grove, Shiloh area developers and two engineering firms on September 5, 2013 where the County did not object to the preliminary alignment of the road network, or the extension of the stormwater management system into NE 29-52-27-W4M. That said, a Memorandum of Understanding (MOU) was to be prepared after this meeting, and was to be circulated to all three municipalities to seek "formal authorization" for the proposed road alignment. The revised MOU, received on July 10, 2014, is included in Attachment 3 - Revised Memorandum of Understanding.
In late June 2014, Parkland County received a Notice of Public Hearing for the proposed amendments to the Shiloh Area Structure Plan, and the supporting amendments to the Spruce Grove Municipal Development Plan and Land Use Bylaw. Parkland County provided a letter outlining its concerns about a signed MOU not being signed, and on the inadequate consultation by the City of Spruce Grove and the Shiloh area developers and consultants on the proposed ASP amendments. Attachment 4 includes the County's original letter to the City of Spruce Grove. On July 14, 2014, Spruce Grove Council held the Public Hearing and gave Second Reading to the amendments to the Shiloh ASP. The City of Spruce Grove submitted the proposed amendments to the Shiloh ASP and MDP to the Capital Region Board for review shortly after the Public Hearing and Second Reading date.
Parkland County's concerns have not been addressed by the City of Spruce Grove prior to the submission of the proposed amendments to the Capital Region Board. In particular, issues with the road extension and the extension of the storm water management scheme into NE 29-52-27-W4M identified in the amended Shiloh ASP have not been addressed. In the spirit of regional collaboration, Administration does not wish to oppose these amendments, but has prepared a draft letter to the Capital Region Board stating that the County will support these amendments to the Shiloh ASP contingent upon additional consultation with the City of Spruce Grove and a signed MOU.
Administration requests Council direction to submit the attached letter to the Capital Region Board for their consideration (see Attachment 5 - Draft letter to the Capital Region Board).
Strategic Plan/Policy/Legal/Staff Implications
Submission of a letter to the Capital Region Board will allow the County's concerns to be formally expressed in front of the Capital Region Board. In addition, by having a signed MOU, Parkland County will be protected from assuming any costs associated with the capital construction and operating and maintenance costs for any future road extension. Additional (more substantive) consultation with the City of Spruce Grove will also allow the County to work out outstanding engineering or planning issues related with the road or storm water servicing extensions into NE 29-52-27-W4M.
