Administration Recommendation(s)
Administration supports the adoption of Bylaw 2014-29.  The Acheson Industrial Area Structure Plan (ASP) will provide certainty as to how and when the Acheson area will develop in the future. The Bylaw proposes an orderly and efficient development pattern that highlights the importance of Acheson as an employment centre in the Capital Region, while balancing the needs of adjacent municipalities and stakeholders. Adoption of the Acheson Industrial ASP Bylaw No. 2014-29 will replace the existing Acheson Industrial Area Structure Plan Bylaw No. 20-97 and amendments thereto (includes Bylaw No. 45-2000, Bylaw No. 47-01, Bylaw No. 11-2009, and Bylaw No. 37-2011).  
 
Purpose
Council has directed Administration to update the Acheson Industrial ASP.
 
Summary
In February 2013, the update to the Acheson Industrial ASP Bylaw 20-97 was rejected by the Capital Region Board (CRB).  In May 2014, Council directed Administration to meet with representatives from the City of Edmonton and the City of Spruce Grove to address their outstanding concerns with the updated (draft) ASP.  Between May and September 2014, Administration met with the City of Edmonton and Spruce Grove to address their concerns and identify potential changes to the draft ASP.  Through a series of six (6) facilitated sessions, Administration, along with staff from both the City of Edmonton and City of Spruce Grove, identified several changes to the Draft ASP.  In August 2014, Administration undertook several changes to the ASP.  Significant changes in the updated Draft ASP include:
 
1. Administration added a new Section 5.2 - Lands Available for Development, and updated Section 5.1 - Industrial Development, and Section 5.9 - Agriculture;
 
2.  Administration updated Policy Section 6.1 - Industrial Development to clarify the industrial and commercial type uses to be expected in the ASP area, and to re-introduce the concept of "Design Overlays";
 
3. Administration updated Policy Section 6.2 - Agriculture by introducing policies for "Agricultural Area A" and "Agricultural Area B";
 
4. Administration updated Policy Section 7.0 - Development Staging by refining potential staging timelines for S1, S2 and S3 lands;
 
5. Administration updated Figure 6 - Land Use Concept map, and Figure 15 - Development Staging map.
 
Administration also updated all existing land use and projected employment statistics for the ASP area, as well as all other ASP mapping with current information.   Revisions to the draft ASP reflect prior decisions made in meetings held with the City of Spruce Grove and the City of Edmonton representatives.
 
Administration received several concerns from impacted stakeholders and landowners at two (2) public open houses held on October 6, 2014, and November 7, 2014.  The Draft ASP has been revised to address several of these concerns.  Attachment 5 identifies these concerns, as well as Adminstration's response to these concerns.  Attachment 6 outlines resident / stakeholder letters received (to date) on the Draft Acheson ASP.  Administration provided responses in red font (note - Administration has not had the opportunity to respond to all letters as of the time of this Council Report submission).
 
Strategic Plan/Policy/Legal/Staff Implications
 
Municipal Development Plan Bylaw No. 37-2007
 
Bylaw No. 2014-28 is being brought forward at the same meeting as Bylaw No. 2014-29.  Bylaw No. 2014-28 proposes changes to the Municipal Development Plan.  Proposed amendments include a minor text amendment to Section 1 - Introduction, the addition of a policy in Section 5 - Industrial and Commercial Development, the addition of a policy in Section 10 - Transportation and Utilities, and a new policies under Section 11 - Fringe Area Development, as well as map amendments to Map 2 - Future Land Use Concept Map, and Map 3- Parkland County Area Structure Plans.
 
Changes proposed in the Municipal Development Plan Bylaw are being proposed to ensure compliance with Part 17, Section 638 of the Municipal Government Act which requires all statutory plans to be consistent with each other.
 
Rescinding of Bylaw No. 20-97 as amended
 
Adoption of the Acheson Industrial ASP Bylaw No. 2014-29 will require Bylaw No. 20-97 (the current Acheson Industrial ASP) and all amendments thereto to be rescinded.   Council will be asked to rescind these as part of the Acheson Industrial ASP Bylaw No. 2014-29 approval.
 
The Draft Acheson Area Industrial ASP will be submitted to the Capital Region Board, for their review and approval, after Council gives second reading to the bylaw.
 
Alternate Motions:
Alternative Motions include:
 
a) Table first reading of the proposed Acheson Industrial Area Structure Plan Bylaw No. 2014-29 and request further information.
 
b) Refuse first reading of the proposed Acheson Industrial Area Structure Plan Bylaw No. 2014-29.
 
If Council chooses to table first reading of Bylaw No. 2014-29, Administration requests Council to provide direction as to what type of information is requested.     
 
If Council chooses to refuse first reading of the Acheson Industrial ASP Bylaw No. 2014-29,  Administration recommends that the existing Acheson Industrial ASP Bylaw No. 20-97 and all amendments thereto, not be rescinded.  This will ensure that an area structure plan (Bylaw No. 20-97) would still exist for the Acheson area.  Administration would also request that Bylaw No. 2014-28 (amendments to the MDP) not proceed.
