Title
APPEAL HEARING - 11:30 a.m. (30 mins.)
Scorpion Construction is appealing the One Week Suspension of their Haul Agreement 2013-H-34.
Proposed Motion(s)
Council uphold the suspension issued under the authority of Parkland County Haul Agreement 2013-H-34:
- June 18, 2014 about 1019 hours a gravel truck traveling off of the authorized route
- June 18, 2014 about 1103 hours a second gravel truck traveling off of the authorized route
Due to the closeness in times, less then one hour, Enforcement Services treated this as one violation, not two - a one week suspension.
Body
Administration Recommendation(s)
Administration supports the suspension of Scorpion Construction Haul Agreement 2013-H-34 for the specific time period.
Purpose
Scorpion Construction is facing a one week suspension.
June 18, 2014 there were two separate gravel trucks traveling off of the authorized haul route. This is the second infraction.
The first infraction of traveling off the authorized route was August 29, 2013.
Summary
On June 18, Enforcement Services Peace Officers were on patrol in the Range Road 51 and Highway16 area as part the gravel focused enforcement. This area has four approved gravel pits. At about 1019 hours a gravel truck was stopped traveling westbound on the service road east of Range Road 51. This truck was not displaying Alberta Sand & Gravel Association numbers, as required. It was determined the operator of this truck had purchased gravel from Scorpion Construction. This driver had been observed by the officer hauling from Scorpion Construction the prior week. At about 1109 hours a second gravel truck was stopped on the service road on the north side of Highway 16, traveling between Range Roads 51 & 52. This second gravel truck was not displaying Alberta Sand & Gravel Assocaiton numbers either.
The authorized route for Scorpion Construction Haul Agreement 2013-H-34, as of June 10, 2014, allows empty gravel trucks to travel north on Range Road 52, to Township Road 534, then east to Range Road 51. Loaded gravel trucks must use Rge Rd 51 only. Empty gravel trucks may travel north on Rge Rd 51 as well. The municipal address for the Scorpion Construction gravel pit is 53313 Range Road 51.
