Purpose

To provide Council with the final Parkland County and Sturgeon County Intermunicipal Collaboration Framework (ICF) Bylaw.

 

Summary

Section 708.28 of the Municipal Government Act (MGA) requires Parkland County to complete intermunicipal collaboration frameworks (ICFs) with all municipalities sharing common boundaries where neighbouring municipalities are not members of a growth management board. ICFs reinforce existing collaborations and formalizes a process for municipalities to work together. Five specific service areas; transportation, water and wastewater, solid waste, emergency services and recreation must be included in an ICF, plus any other services that benefit residents in more than one of the municipalities involved. ICFs must also contain an agreed to dispute resolution process to manage disputes that arise regarding the delivery and cost sharing of services after the ICF has been adopted. All municipal collaboration frameworks must be completed by April 2020. All municipalities party to the ICF must also have an intermunicipal development plan (IDP) that is compliant with the new MGA requirements.

 

Municipalities that are members of a growth management board are required to create a framework with other members of the same growth management board only in respect of those matters that are not addressed in the growth plan or the servicing plan. Since both Sturgeon County and Parkland County are members of the Edmonton Metropolitan Region Board (EMRB), it is intended that the Metropolitan Region Servicing Plan will act as ICF for all services excluding Recreation and any other services. As members of the EMRB and party to the Edmonton Metropolitan Region Growth Plan, the municipalities are exempt from the requirement to prepare an Intermunicipal Development Plan (IDP) as part of this ICF.

Sturgeon County has the ICF on the September 24, 2019 Council agenda.  

 

Strategic Plan/Policy/Legal/Staff Implications:

In accordance with the MGA, intermunicipal collaboration frameworks must be approved by the adoption of matching bylaw by partnering municipalities. The Administrations of both Parkland County and Sturgeon County have collaborated to ensure that the ICF meets the requirements in the MGA and the expectations of both municipalities. They have also collaborated to ensure the bylaws to be adopted by both municipalities are consistent.
