Administration Recommendation

Administration recommends that Council pass Bylaw 2025-30 to remove the requirement to appoint members of Council to the Subdivision and Development Appeal Board.

 

Purpose

To present Bylaw 2025-30 that rescinds Bylaw 2022-08 which sets out the amending clauses that require Council to appoint up to two (2) members of council to the Subdivision and Development Appeal Board.

 

Summary

Council directed that administration prepare a Bylaw amending the Subdivision and Development Appeal Board Bylaw to remove appointments of Councillors to the Subdivision and Development Appeal Board.

 

Administration proposes Bylaw 2025-30 for Council's consideration to remove the requirement of Council to appoint members of Council to the County's Subdivision and Development Appeal Board. The proposed bylaw will rescind Bylaw 2022-08 effectively removing three amendments to Bylaw 2018-26 reverting the wording in section 5, section 16 and section 18 to their original form found in Bylaw 2018-26.

 

By passing proposed Bylaw 2025-30 Council will remove the appointments of Councillors to the Subdivision and Development Appeal Board.

 

Historical Information:

On November 13, 2018 Council passed Bylaw 2018-26-Subdivision and Development Appeal Board Bylaw.

 

On May 24, 2022 Council passed Bylaw 2022-08-Amending Subdivision and Development Appeal Board Bylaw 2018-26. The passing of this bylaw amended the following three sections in Bylaw 2018-26:

 

     1. Section 5 - was amended to read: "Council shall appoint a pool of up to twelve (12) public members and up to two (2) council members. Council members are appointed annually at the organizational meeting of council. A panel hearing

                           an appeal must not have more than one (1) councillor as a member of the Board."

 

     2. Section 16 - was amended to read: "During the Organizational meeting of the Subdivision and Development Appeal Board, members of the Board shall elect from the appointed public members up to three (3) Chairpersons to serve on

                             a rotational basis. A chairperson shall not be a council member of the Board."

 

     3. Section 18 - was amended to read: " A quorum of the Board Shall be at minimum three (3) members, and may include up to one (1) Council member."

 

On March 14, 2023 Council passed Bylaw 2023-01-Amending Subdivision and Development Appeal Board Bylaw 2018-26. The passing of this bylaw added section 27 to Bylaw 2018-26. Section 27 states that: "A hearing may be held by electronic means which may be a video conferencing tool, a telephone conference call, or a hybrid approach combining virtual and in-person participation, as set out in Section 199 of the Municipal Government Act, RSA 2000, as amended or repealed."

 

On October 28, 2025 Council directed that administration prepare a Bylaw amending the Subdivision and Development Appeal Board Bylaw to remove appointments of Councillors to the Board for Council's consideration at the December 9, 2025 Council meeting.
