Title

9:30 a.m. Public Hearing - Bylaw 2022-10 - Text Amendment to Land Use Bylaw 2017-18 Section 4.1.2(c) for site specific discretionary use (Storage, Warehousing and Distribution, Outdoor) within AGG-Agricultural General District.

Administration Recommendation

Administration supports the proposed motions, as presented, as the proposed amendment is consistent with goals of the Municipal Development Plan, the Acheson Industrial Area Structure Plan and the Parkland County 2022-2025 Strategic Plan.

 

Administration recommends that the Public Hearing commence at the October 11, 2022 Council meeting at 9:30 a.m. as scheduled at the September 13, 2022 Council meeting at which Bylaw 2022-10 received first reading.  Administration recommends that Council hear public comment in accordance with section 216 of the Municipal Government Act.  Should Council be satisfied with information received at the Public Hearing, administration recommends that the Public Hearing be closed and that Bylaw 2022-10 be presented to Council for second and third reading at this meeting.  Alternatively, should Council desire to receive further information for the Public Hearing, Council may adjourn the Public Hearing to continue to receive additional information accordingly.

 

Additionally, if Council desires to close the Public Hearing but allow for Bylaw 2022-10 to be considered for second and third reading at the next meeting, Council may move:  That Bylaw 2022-10 be presented for second and third reading on October 25, 2022 at a regular scheduled meeting of Council.

 

Purpose

To amend the Land Use Bylaw 2017-18 to add a site specific use in the AGG-Agricultural General District, being Storage, Warehousing and Distribution, Outdoor as a discretionary use only on a parcel legally described as Plan 167MC Lot 3.

 

Summary

Administration finds the application to be in line with the future intent for this area as established within the Municipal Development Plan and the Acheson Industrial Area Structure Plan and is in line with the Strategic Economic Development pillar of the Parkland County Strategic Plan 2022-2025.

 

Proposed Bylaw 2022-10 is a Land Use Bylaw text amendment to allow for the future development of a Storage, Warehouse and Distribution, Outdoor business to occur on Plan 167MC Lot 3. This use in not listed in the AGG-Agricultural General District and as such, the applicant is proposing a site specific LUB amendment to allow for this type of development, specifically on the subject parcel. This would allow for a future development permit to be issued for Storage, Warehousing and Distribution, Outdoor, without the requirement to redistrict the lands to an Industrial District, which would require connection to municipal services. Policy within the MDP and Acheson Industrial ASP require redistricting and servicing to carry out industrial and commercial development on the subject lands, however, administration recognizes the subject lands present challenges to viable municipal servicing in the short term, and perhaps long-term, and are geographically isolated from current development in Acheson. Administration supports the site specific amendment.

 

Administration supports the site specific amendment for the subject lands because it allows for the intermediate use of these lands for a limited scale development without negatively impacting the long term potential development of the area.

 

Strategic Plan/Policy/Legal/Staff Implications:

The proposed amendment is consistent with goals of the Municipal Development Plan No. 2017-14, the Acheson Industrial Area Structure Plan No. 2020-13 and the Parkland County 2022-2025 Strategic Plan.
