That Bylaw No. 2016-04 receive first reading.

Administration Recommendation

Administration supports this road closure for the purpose of sale and consolidation into two adjacent private titles.

 

Purpose

The adjacent landowners of the undeveloped Township Road 522 identified in Bylaw 2016-04 have requested to purchase the road allowance.

 

Summary

In 2015, Parkland County was notified that a fence had been constructed in the undeveloped road allowance, encompassing approximately 19 of the 20 metres. The County had not issued an agreement to fence and graze these lands.

 

In July 2015, Engineering Services received a request along with a $600.00 application fee from the landowner of Lot 8 to close this portion of Township Road 522 with the intent to purchase 100% of the area. In October 2015, Engineering Services received a different request along with a $600.00 application fee from the landowner of Lot 1 to close this portion of Township Road 522 with the intent to purchase 100% of the area. 

 

Following the receipt of the two applications, Engineering Services a sent letter to each landowner advising each other of their requests. This was done in October 2015. Information was provided at that time what the cost would be to purchase 50% of the road allowance.

 

The landowners submitted a joint application along with $300.00 each to cover the costs of the application process. This joint fee (2x$300.00) replaced the original individual fees of $600.00.

 

Parkland County Lots R8 and R9 will remain accessible through Lots R1 and R2 as well as the easterly portion of Township Road 522.

 

As an additional piece of infomation, Administration confirms this portion of Township Road 522 within Garden Grove Estates has not previously been closed. At the Public Hearing on February 9, 2016, a member of the public provided information suggesting that the area under consideration had been closed in 1998. This is not correct. A different portion of Township Road 522 was closed and it did not include the area identified within Bylaw 2016-04.

 

An internal Parkland County circulation was completed as well as the required advertisement and notification to Alberta Transportation and adjacent landowners.  No concerns were identified.

This request meets the requirements of the Road Allowances and Diversions - Sales, Lease or Permitting Policy EN 009.

 

Financial Impact:

Cost:  Parkland County to receive Market Value for the lands plus increased property tax assessment.
