Administration Recommendation

Administration supports the proposed motion to receive first reading. Following the completion of the public hearing and first reading, the bylaw will be forwarded to Alberta Transportation and Economic Corridors (ATEC) for review and approval.

 

Purpose

To close a portion of road allowance for the purpose of lease.

Summary

A formal application has been made to close a portion (~0.037 ha / ~0.091 ac) of Second Street East in the South Seba subdivision for the purpose of lease. The portion of Second Street East proposed to be closed is adjacent to the east property boundary of Plan 6053HW, Block 1, Lot 1, as shown on attachment "2. Road Closure Area".

The existing road allowance is undeveloped and connects Lake View Ave to park reserve land bordering Wabamun Lake. This road allowance runs immediately adjacent to an existing residence before leading to a steep slope down to the shore of Wabamun Lake. There exists a wider road allowance providing access to the park reserve approximately 250m west of the proposed closure area as well as additional access locations to the park reserve within the South Seba subdivision. Preliminary circulation to Alberta Transportation and Economic Corridors (ATEC) was completed with ATEC noting that closure of this portion of road allowance does not remove legal access to any parcel and does not unreasonably restrict public access to the lake given the alternative nearby access points. Internal circulation was completed with no concerns about a closure for the purpose of leasing.

The proposed lease would provide the lot owner of Plan 6053HW, Block 1, Lot 1 greater opportunity to use and maintain the space at the east edge of their property while limiting encroachments into road right-of-way and potential security and privacy concerns with the close proximity of their residence.

This road closure has been identified as for lease (vs. sale) allowing the County to retain long term control over the road allowance for any future drainage or access requirements. There are currently no plans to develop this portion of Second Street East and lake access at this location is challenging due to the slope of the shoreline and an existing drainage channel that runs down the slope at this location.

 

Historical Information:

Encroachments into this road allowance were removed by the applicant at County request.

This request complies with Section 22(4) and Section 606 of the MGA and Parkland County Policy EN009 Road Allowances and Diversions - Sales, Lease or Permitting.

 

Financial Impact:

Revenue: Annual Road Right-of-Way lease rate per acre as set out in Parkland County's Fees & Charges Schedule, property tax on leased lands.
