That the Partridge Place Land Use Petition Report be accepted for information, as presented.

Purpose

To fulfill the Chief Administrative Officer's responsibility to report to Council on the sufficiency of the petition.

 

Summary

The Partridge Place Land Use Petition is insufficient due to deficiencies in the requirements of Sections 223, 224(2)(a), 224(3)(b) and 224(4) of the Municipal Government Act of Alberta.  This petition requested Parkland County to enforce Section 12.6 of Land Use Bylaw 2009-20 in relation to the construction of a confined feeding operation on the W5M-1-53-15 NE.

 

Petition Policy C-AD09 allows petitions that do not meet the requirements of the Municipal Government Act to be considered a Petition or Statement of Support that reinforces public participation and communicates the opinions of residents.

 

Strategic Plan/Policy/Legal/Staff Implications

Sections 223, 224, and 225 of the Municipal Government Act provide the legislated requirements for a petition and the counting of petitioners.  Section 226 of the MGA compels the Chief Administrative Officer to make a report to Council on the sufficiency of a petition.  

 

Section 12.6 of the Land Use Bylaw 2009-20 addresses development adjacent to confined feeding operations.  Confined feeding operations are regulated by the Natural Conservation Board in accordance with provincial regulations and are exempt from municipal control under this Bylaw.

 

Petition Policy C-AD09 permits non-statutory petitions (e.g. insufficient petitions) to be referred to administration for action and/or reply.
