Proposed Motion

That Council appoint the members of Parkland County's Agricultural Service Board as the committee to hear and determine appeals under section 14 of the Agricultural Pests Act for the period October 13, 2026 to October 12, 2027.

Administration Recommendation

Administration recommends that Council appoint the public members of Parkland County's Agricultural Service Board as the committee to hear and determine appeals under section 14 of the Agricultural Pests Act for the period October 13, 2026 to October 12, 2027.

 

Purpose

For Council to fulfill its statutory responsibility under section 14(5) of the Agricultural Pests Act by annually appointing a committee to hear and determine appeals of inspector’s notices issued under the Act.

 

Summary

Section 14(5) of the Agricultural Pests Act requires a local authority to annually appoint a committee to hear and determine appeals under section 14. When a notice of appeal is received, the local authority must refer the appeal to the appointed committee. Under the Act, the local authority for Parkland County is Council.

 

Parkland County’s Agricultural Service Board Terms of Reference provide that the Agricultural Service Board will act as the committee to hear and determine appeals under the Agricultural Pests Act. Administration therefore recommends that Council appoint the public members of the Agricultural Service Board as the appeal committee for the proposed one-year period.
