Proposed Motion

That Council waive the one (1) year waiting period for the resubmission of the Land Use Bylaw amendment related to regulations and definitions for the Highvale End Land Use Direct Control District Regulations (DC Area 2) in accordance with Land Use Bylaw 2017-18, Section 19.6.1, as presented.

Administration supports the proposed motion.

 

Purpose

Administration is requesting that Council waive the one (1) year waiting period to allow for the resubmission of the Land Use Bylaw amendment in accordance with Land Use Bylaw 2017-18, Section 19.6.1.

 

Summary

On March 11, 2025, Council recessed the public hearing and approved a motion to establish a Special Council meeting on March 27, 2025, at 9:00 a.m. at Parkland County Council Chambers to resume the Public Hearing for Bylaw 2025-08.

 

On March 27, 2025, following closure of the Public Hearing, Council defeated Bylaw 2025-08. 

 

As per Land Use Bylaw 2017-18 Section 19.6.1, where an application for an amendment to the Land Use Bylaw has been defeated by Council, another application for the same or substantially the same amendment shall not be considered within one (1) year of the date of the refusal unless Council directs otherwise. 

 

To support public interest, administration is requesting that Council waive the one year waiting period in accordance with policy 19.6.1 of Land Use Bylaw 2017-18. This waiver will provide the opportunity for additional information, clarification on the matter, and to allow for additional public engagement and input.
