Administration supports the road closure.
Purpose
To close and lease the road allowance to the adjacent landowner.
Summary
Bylaw 2015-12 closes portions of Range Road 32 and Township Road 534 that are adjacent to the N1/2 27-53-3-W5M. Upon road closure Parkland County intends to lease these road allowances to MWC Investments Inc. (MCW); the owner of the N1/2 27-53-3-W5.
MCW leases their property to Burnco Rock Products Ltd. (Burnco) for gravel extraction purposes, and MCW intends to add these road allowances to their lease with Burnco. This allows Burnco to extend their existing gravel operation into these road allowances and includes the road allowances in Burnco's reclamation plan. Burnco has a Road Allowance Aggregates Royalty Agreement with Alberta Transportation.
The Municipal Government Act (MGA) of Alberta requires road closure bylaws to be advertised, hold approval from the Minister of Transportation, and allow persons who claim to be harmed by the bylaw to be heard by Council. The County has satisfied legislative requirements by advertising and conducting a public hearing on March 3, 2015, and obtaining road closure approval from the Minister of Transportation on April 23, 2015.
