Administration does not support this request unless a condition is attached that requires the landowner to remove all other encroachments within Lot 36ER including the retaining walls, stairs, landscaping, skate shack, and return that portion of 36ER back to its original state to the satisfaction of Parkland County.
Purpose
An application has been made by the landowners of Lots 13 and 14 Block 1 Plan 802 1782 to relocate a portion of Lot 36ER due to an encroachment by a detached garage. Council must consider whether to approve the requested boundary change to this County owned Environmental Reserve parcel (36ER).
Summary
In order to rectify the encroachment of a detached garage on a portion of Lot 36ER, the applicant has proposed the relocation of a portion of Lot 36ER and completion of a lot line adjustment between Lots 13 and 14 as part of a separate subdivision application to Parkland County. At the time of this report the subdivision application had not yet been considered by the Municipal Planning Commission; however, MPC's decision will be made on May 7th 2012 and therefore shall be available to Council on May 8th 2012 prior to Third Reading of this Bylaw. A Plan of Survey showing the ER boundary change and relocation, as well as the lot line adjustment between lots 13 and 14 will be required to finalize this request.
The additional encroachments into Lot 36ER have been outlined in Administration's Report. Due to the amended motion by Council at Second Reading, the condition that the landowners remove all other encroachments within Lot 36ER has been removed from Bylaw No. 06-2012.
