Administration supports the passing of this Bylaw.

 

Purpose

The proposed Bylaw is required to meet the requirements of the Access to Information Act to designate a person as the head of the local public body, and to set any fees the local public body requires to be paid for services.

 

Summary

On June 11, 2025 Alberta's Freedom of Information and Protection of Privacy Act was replaced with two distinct pieces of legislation: the Access to Information Act and the Protection of Privacy Act (the "Act"). Section 98(a) of the Act requires that Parkland County must designate a person or group of persons as the head of the local public body for the purposes of the Act. Section 98(b) of the Act states that by Bylaw the County may set any fees the local public body requires to be paid under section 96, however the fees set by the County must not exceed the fees set out in the regulation. The proposed Bylaw, in section 5, states that Parkland County will collect fees for services in accordance with the Access to Information Act and Regulation, as amended from time to time.

The proposed Bylaw replaces Parkland County Bylaw 2015-32 - Freedom of Information and Protection of Privacy (FOIP).
