Administration Recommendation

Administration supports the proposed motions.

 

Purpose

To align Parkland County's 2024 Fees and Charges Bylaw with Community Standards Bylaw 2023-19 that was passed by Council under the major bylaw review project that imply penalties to be included in the 2024 Fees and Charges Bylaw 2023-11.

 

To amend the 2024 Fees and Charges Schedule E.2 and E.5 for Planning & Development Services to include additional changes from the 2023 Fees and Charges.

 

Summary

Administration conducted a major bylaw review project in 2023.  In the fall of 2023, administration presented for Council's approval: Community Standards Bylaw.  The bylaw imposes penalties that would be included in the 2024 Fees and Charges Bylaw 2023-11.

 

By adding the penalties associated with the enforcement of Bylaw, it ensures that penalty amounts are reviewed annually.

 

Strategic Plan/Policy/Legal/Staff Implications:

MGA s. 8(c) requires that fees for permits, licenses and approvals must be established by bylaw.

MGA s. 191 provides that the amendment or repeal of a bylaw must be made in the same way as the original bylaw.
