Purpose
This agreement is the mechanism Alberta Transportation has chosen to ensure that local governments will provide the necessary transportation plans and assessments for supporting the Freeways and Access Locations Designation Order approved by Order in Council 587/2009.
Summary
Subject to Section 4 of the Highways Development and Protection Regulation (HDPR), the construction of any development within the development control zone of a provincial highway is prohibited unless a roadside development permit from Alberta Transportation (AT) is obtained. Section 5 of the HDPR, prohibits AT from issuing roadside development permits within the development control zone designated freeways until the local municipality has entered into a specific agreement with their department and has provided specific planning that is acceptable to them.
As this forms part of a piece of legislation, the Minister of Alberta Transportation is responsible to see compliance of the HDPR and the Order in Council on Freeways and Access location. Cognizant that local governments are developing land near freeway corridors, the Minister requests local governments to accept and sign the Freeway Intersection Removal Agreement to make sure every effort is being made to encourage development within our communities without detrimentally impacting the Provincial Freeways.
