Purpose

To fulfill the Chief Administrative Officer's responsibility to report to Council on the sufficiency of the petition.

 

Summary

The Mallard Park petition is sufficient since it meets the requirements of the Municipal Government Act (MGA) of Alberta and Parkland County Country Residential Road Surfacing Policy EN 001.

 

Strategic Plan/Policy/Legal/Staff Implications (As Required)

Sections 224 and 225 of the MGA provide the legislated requirements for a petition and the counting of petitioners.  Section 226 of the MGA compels the Chief Administrative Officer to make a report to Council on the sufficiency of a petition. 

 

Country Residential Road Surfacing Policy EN 001 lets administration consider the surfacing of roadways in a residential subdivision where development has occurred on at least 50% of the properties, and residents submit a sufficient petition that is signed by at least 2/3 of the property owners that hold at least 1/2 the value of property assessments for that subdivision.
