Road Closure for the Purpose of Sale and Consolidation - All of Road Plan 3972ET Within SE 7-53-3-W5

Administration supports the proposed motion.

Purpose
To close all of Road Plan 3972ET within SE 7-53-3-W5 (3.86 ac/ 1.56 ha) for the purpose of sale and consolidation into the adjacent parcel.

Summary
A formal request was received to close all of remaining Road Plan 3972ET within SE 7-53-3-W5 (3.86 ac/ 1.56 ha) for the purpose of sale and consolidation into an existing parcel (SE 7-53-3-W5). Road Plan 3972ET, which was surveyed in 1940 to avoid a swamp area, remains undeveloped. The road constructed and maintained east of the swamp area, Range Road 35, replaces any current and future foreseen County requirement for subject Road Plan 3972ET. The existing Certificate of Title encompasses the lands both east and west of this undeveloped road.

Administration has reviewed the proposed road closure and supports the closure for sale motion. Alberta Environment and Parks does not object with the closure of this road right-of-way. Alberta Transportation and Economic Corridor (ATEC)'s response read the proposed closure would not result in any parcel losing legal or physical access. The closure does not appear to unreasonably impact public access to any water body or recreational opportunity. The closure will not affect ATEC's plans for a local road connector supporting the future freeway operation of Highway 16. As such, it is understood ATEC does not object to the proposed closure.

Administration has completed Road Closure requirements identified in the Municipal Government Act Section 22(1), giving notice of this Public Hearing in accordance with Section 606.
