Administration supports the proposed motion.

Purpose
To amend the metes and bounds description of Bylaw 2021-24 to meet Alberta Land Titles requirements for finalization of the approved road allowance closure, sale, and consolidation.

Summary
Bylaw 2021-24 was previously given third reading and passed on February 14, 2023 to close a portion of Railway Ave to public travel for the purpose of sale and consolidation with the adjacent parcel. This closure was done with the intention of including the entirety of the existing dwelling within the residential parcel adjacent to Railway Ave in Fallis. Upon submission of the documents to Alberta Land Tiles, the submission was deemed unacceptable and corrections were required to the metes and bounds description, necessitating an amendment to the Bylaw as proposed in Bylaw 2024-07. This bylaw will amend the metes and bounds description to the format required by Alberta Land Titles for resubmission and finalization of the sale/consolidation.

Bylaw 2021-24 was initially given a public hearing and first reading on December 14, 2021 with written submissions from area residents both for and against the bylaw being considered by Council. The signed bylaw was then submitted to Alberta Transportation and returned signed on August 11, 2022. Second and third reading were completed and the bylaw finally passed on February 14, 2023.
