Purpose
The Applicants are requesting a Land Use Bylaw amendment to redistrict the subject lands to bring the properties, and associated uses occuring on the lands, into conformance with the County's Land Use Bylaw.
Summary
The Applicants have made a joint application to amend the Land Use Bylaw to redistrict the four existing properties located at the northeast quadrant of Range Road 15 (Beach Corner Road) and Highway 16A from the CR - Country Residential District to the LC - Local Commercial District. The four businesses have been in operation for a number of years under separate valid development permit approvals from the County. Under the previous 1994 and 2000 Land Use Bylaws Convenience Retail Services and Liquor Sales/Distribution Services were discretionary uses within the Country Residential Core District. Site specific amendments were also adopted to allow the two liquor sales outlets to be located in proximity of adjacent multi-parcel residential subdivisions. These amendments were removed during the adoption of current Land Use Bylaw No 20-2009 on July 1, 2009. Therefore these properties are currently considered legal non-conforming as defined under Section 643 of the Municipal Government Act. The Applicants are making an application to redistrict the properties to the LC-Local Commercial District to bring the properties into a conforming state.
