1. That Bylaw No. 2015-08 receive second reading.

Administration Recommendation(s)
Administration recommends that Council close the public hearing and defeat the bylaw at second reading. The applicant may file a similar application at a future date after all recently identified issues (i.e. Safety Codes and Occupational Health and Safety) have been satisfactorily resolved. Administration notes that Council can choose not to hear a similar application for a period of up to one year. Public consultation will be a requirement of any new application as the County has significant complaints/concerns regarding the property and current use.
Purpose
The applicant is requesting a Land Use Bylaw amendment to redistrict the subject lands to allow for planned future expansion, maintenance and additional investment into the existing steel fabrication plant.

Summary
The Applicant has made an application to amend the Land Use Bylaw and redistrict Plan 5389RS, Lot A (Linc Number 0016 884 967) from the CR - Country Residential District to the RIC - Rural Industrial Commercial District. Parkland County’s Municipal Development Plan does not offer any direction on where the RIC District should be located (or potentially not located). Preliminarily, Administration is of the opinion that this development site (proposed use) meets the criteria of the RIC District however several issues with the operation of the facility have arisen through the public hearing process.
