Purpose
An application was made in 2012 by the landowners of Lots 13 and 14, Block 1, Plan 8021782 to relocate a portion of Lot 36ER due to an encroachment by a detached accessory structure (garage).
Summary
Bylaw No. 06-2012 was passed by Council on May 8, 2012 (after public hearing held April 10, 2012) to amend the boundaries of Environmental Reserve Lot 36 ER, Block 1, Plan 8021782 to rectify the encroachment of a detached garage. The applicant has failed to register the amended boundaries within the 365 days allotted, therefore, Bylaw No. 06-2012 is now redundant and a new bylaw (Bylaw No. 2013-21) is needed to allow for an additional 365 days for the applicant to register the lands.
At first reading of this Bylaw Council had concerns regarding the lot drainage of the area. The applicant is required to address the lot drainage as per condition 5 of subdivision approval 12-S-016 that reads as follows:
"Pursuant to section 655 of the Municipal Government Act, the applicant shall ensure that the consolidated portion of Lot 13 is graded to the satisfaction of Parkland County's Engineering Department. The applicant shall submit signed and sealed drawings from a Professional Engineer showing flow directions and drainage details to the satisfaction of Engineering Services.
