Alberta Transportation License Agreement - Devonian Gardens Trail Link
Proposed Motion
That Council approve execution of the License Agreement with the Province of Alberta as presented in Attachment #1 for a 5 year term for development of a portion of the Devonian Trail Link.

Purpose
To put a 5 year agreement in place allowing Parkland County's development and on going operation of a trail in the highway right of way along Highway 60 between Banksiana Road and Devonian Botanical Gardens.
Summary
Parkland County will be developing the Devonian Gardens Trail Link as part of the River Valley Alliances (RVA) Plan of Action. The RVA obtained funding for this trail and the other Plan of Action projects from the Federal and Provincial Governments. Parkland County entered into a Municipal Funding Agreement with the RVA which outlines the terms and conditions the County must adhere to in order to access this funding support. Initially, one of the conditions in the Municipal Funding Agreement is all land or assets grant funding is used for must be in place for a minimum of 25 years, however this requirement has recently been reduced to a 5 year term which is reflected in the attached License Agreement.
A portion of the Devonian Gardens Trail Link will be run along the Highway 60 right of way from Banksiana Road to the Devonian Gardens parking lot. In order to meet the conditions in our Municipal Funding Agreement, Parkland County and the Province of Alberta have developed the attached License Agreement.
