Summary
The Wendel Place petition is sufficient and meets the requirements of the Municipal Government Act of Alberta and Parkland County Country Residential Road Surfacing Policy EN 001.
Strategic Plan/Policy/Legal/Staff Implications
Sections 224 and 225 of the Municipal Government Act provide the legislated requirements for a petition and the counting of petitioners. Section 226 of the MGA compels the Chief Administrative Officer to make a report to Council on the sufficiency of a petition.
Country Residential Road Surfacing Policy EN 001 lets administration consider the surfacing of roadways in a residential subdivision where development has occurred on at least 50% of the properties, and residents submit a sufficient petition that is signed by at least 2/3 of the property owners that hold at least 1/2 the value of property assessments for that subdivision.
