Purpose
To provide the Committee of the Whole with an update of the Horizon Stage ownership.

Summary
Parkland County and the City of Spruce Grove have enjoyed a 22 year partnership for the Horizon Stage facility each believing to be a 50% owner. The facility provides the only performance theatre venue in the tri region and supports a multitude of arts and cultural events that serve our residents. In late 2015 during Joint Use discussions between the City of Spruce Grove and Parkland School Division (PSD) questions around ownership of the Horizon Stage emerged. The PSD believed that they, as opposed to Parkland County, were 50% owners of the facility along with the City of Spruce Grove. It is believed this occurred as part of the separation that occurred in 1995 when Parkland County and Parkland School Division split into two separate entities. Legal opinion was obtained and indicates that it is likely that the facility is jointly owned by the City of Spruce Grove and Parkland School Division.

The Cost Share Agreement Parkland County currently has in place with the City of Spruce Grove (Facility Operator) is in effect until the end of 2017. Administration views this facility as one that would be cost shared on regardless of ownership. The current agreement is similar and in line with our other Recreation Cost Share agreements, where we are not facility owners. The Parks, Recreation and Culture Master Plan will also be completed in 2017 and may potentially provide new direction on Cost Sharing. Given these facts Administration is, with support and agreement from the City of Spruce Grove, maintaining the current agreement. Discussions will begin on a new agreement in Q3 of 2017 and these changes will be taken into account.
