Administration Recommendation

Administration recommends approval of the Subdivision Authority Bylaw.

 

Purpose

To establish the County’s Subdivision Approving Authority in accordance with Section 623 of the Municipal Government Act.

 

Summary

Council must by bylaw provide for a subdivision authority, in accordance with Section 623 of the MGA.  By establishing a Subdivision Authority Bylaw, Council is clearly designating the authority for such approvals while providing a clear framework for such decisions.

 

Currently the Municipal Planning Commission (MPC) Bylaw designates the County’s Subdivision Authority.  Council approved a new Committee structure and has appointed members to the new Committees.  The Municipal Planning Commission is not part of that new Committee structure.  Therefore a bylaw ensuring the ongoing provision of a subdivision authority is required.

 

Should Council repeal the MPC Bylaw 2017-15, a bylaw ensuring the ongoing provision of a development authority is required.

The proposed bylaw complies with Section 623 of the Municipal Government Act and supports Council's strategic goal of Governance.

The Subdivision Authority Bylaw will repeal  Council Policy C-PD-19, Plan Cancellation and Consolidation, and Council Policy C-PD-21, Extension of Subdivision Endorsement and Registration periods.
