Purpose

To close a portion of undeveloped road allowance for the purpose of lease.

 

Summary

Bylaw 2016-23 received first reading on December 13, 2016. 

 

Engineering Services received a request from landowners residing adjacent to the north boundary of an undeveloped section of Township Road 510. The landowners described events where there was trespassing on their lands via access points along the road allowance. Trespassers used the applicants land as well as the road allowance for camping, parties, and dumping of garbage. Upon third and final reading of Bylaw 2016-23, the applicants will enter into a lease for the 3.74 acres. 

 

The Municipal Government Act (MGA) of Alberta requires road closure bylaws be advertised, obtain Minister of Transportation approval and allow persons who claim to be harmed by the Bylaw to be heard by Council.  The County has satisfied legislative requirements by advertising and conducting a public hearing on December 13, 2016 and obtaining road closure approval from the Minister of Transportation on July 17, 2017.

The request complies with Section 22 of the MGA and the County's Road Allowances and Diversions - Sales, Lease or Permitting Policy EN 009.

 

Financial Impact:

Revenue:    Annual lease based on Fees and Charges Schedule inclusive of GST and increased tax revenue for the County.
