Administration supports the proposed motions.

 

Purpose

To close sections of undeveloped and developed road allowances for the purpose of lease.

 

Summary

On April 29, 2008, Council approved TransAlta Corporation's Memorandum of Agreement (MOA) which outlines the plans for expansion within Highvale Mine and the subsequent closure of required statutory road allowances. The process for road closures is outlined in the MOA and states that all road closures are subject to the final passing of a bylaw.

 

TransAlta Corporation has made an application to Parkland County for the closure of several of the road allowance areas shown on the map in the approved MOA. The requested closures are identified within Bylaws 2017-24, 2017-25 and 2017-26. These road allowance closures are for the purpose of lease and will be incorporated into the expansion of TransAlta's Highvale Pit 9. As this expansion continues, it is anticipated that further road closure applications will be submitted to County for approval.

 

An internal Parkland County circulation and notification to Alberta Transportation and Alberta Environment & Parks has been completed with no concerns identified.

 

Strategic Plan/Policy/Legal/Staff Implications 

This request complies with Section 22 (4) and Section 606 of the MGA as well as County's

Road Allowance and Diversions - Sales, Lease or Permitting Policy EN 009.

Revenue:                     Annual Road Right-of-Way lease rate per acre as set out in Parkland County's Fees & Charges Schedule, property tax on leased lands.
