Purpose

To close a section of undeveloped road allowance for the purpose of lease.

 

Summary

In July 2016, AltaLink received approval from the Alberta Utilities Commission (AUC) to construct the Harry Smith 367S Substation. The location of the substation is identified as Area A, Plan 1621772 within the NE corner of the NW-21-52-27-W4.

 

Access to the substation is via an undeveloped portion of Township Road 522. In November 2016, AltaLink and Parkland County entered into a Temporary Workspace Agreement which allowed AltaLink to construct an access road within this portion of Township Road 522. To ensure continued secure access to the Harry Smith Substation, AltaLink wishes for the closure and subsequent lease of this road allowance.

 

The Municipal Government Act (MGA) of Alberta requires road closures to be advertised, obtain Minister of Transportation approval and allow persons who claim to be harmed by the bylaw to be heard by Council. The County has satisfied legislative requirements by advertising and conducting a public hearing on October 10, 2017. Road closure approval for Bylaw 2017-27 was obtained from the Minister of Transportation on February 20, 2018.

The request complies with Section 22 of the MGA and the County's Road Allowance and Diversions - Sales, Lease or Permitting Policy EN 009.

 

Financial Impact:

Revenue:   Annual Road Right-of-Way lease rate per acre as set out in Parkland County's Fees & Charges Schedule, property tax on leased lands.
