Proposed Amendment to Land Use Bylaw 2017-18 re Lands Adjacent to the former Whitewood Mine Site (Bylaw 2018-25)

Administration Recommendation

Administration supports the proposed motions upon closing of the public hearing that Council consider Bylaw 2018-25 to receive second and third reading at this meeting.

 

Purpose

Bylaw 2018-25 will amend Land Use Bylaw 2017-18 to remove the Whitewood DC Overlay from privately owned lands adjacent to the mine area and return the lands to their original land use district.

 

Summary

This Bylaw received first reading at the October 23, 2018 Regular Council Meeting. The attached Administrative Report, associated maps and consultation report and Bylaw were presented at that time; no subsequent changes have been made to these documents.  Also attached is a letter from Alberta Health Services received subsequent to first reading on October 23, 2018 indicating no concerns with the proposed redistricting.

 

Bylaw 2018-25 is an amendment to the Land Use Bylaw 2017-18 and is a follow-up from the redistricting in March 2018 that removed the Whitewood Direct Control Overlay from TransAlta owned lands.

 

Strategic Plan/Policy/Legal/Staff Implications:

The proposed amendment is consistent with goals of the Municipal Development Plan No. 2017-14, and no amendment to the MDP or any Area Structure Plans is required.
